International Residual Mechanism for Criminal Tribunals (IRMCT) delivers its judgment regarding the cases of Prosecutor v. Jovica Stanišić and Franko Simatović

On 30th June 2021, the Trial Chamber of the International Residual Mechanism for Criminal Tribunals (IRMCT) convicted Jovica Stanišić and Franko Simatović for aiding and abetting the crime of murder as a violation of International Humanitarian Law rules and as a crime against humanity. It also found them responsible for the crimes of deportation, forcible transfer, and persecution as crimes against humanity committed by Serb forces following the takeover of Bosanski Šamac in April 1992. The judges of the Trial Chamber stressed how the practical assistance provided by the defendants in this episode of Bosanski Šamac, such as pieces of training and deployment of members of a unit of the Serbian State Security Service and local Serbs in the operation to occupy this municipality, strongly contributed for the commission of such crimes. Accordingly, IRCMT sentenced Mr Stanišić and Mr Simatović to 12 years of imprisonment each. The time they have spent in custody so far will be deducted from this entire amount.
