Even after the Committee on the Rights of Person with Disabilities has noticed the efforts that Indonesia has made to improve and make their education system more inclusive, made experts raise questions in how they want to apply the Convention due to their geographical setup and history with shackling. This is a practice in which a person is being locked into a house or facility due to the stigma surrounding mental disabilities in Indonesia.  

 

The Committed recognized that because Indonesia has a special geographical setup which led the country to decide that each region has the autonomy to establish their own regulations regarding governance. This led to having many different rules when it comes to the rights of people with disabilities and the question from experts on how Indonesia intends to unify these regulations and comply with the Convention. 

 Another question, from an Expert on the Committee, was on how the country wants to give this opportunity to people with disabilities if the practice of shackling is still a widespread practice throughout the country and in the Indonesian legal framework.  

 

Minister of Social Affairs of Indonesia and the head of the Indonesia Delegation, Tri Rismaharini, that it is very challenging due to the setup of Indonesia's landmass, 16,000 Island, and large population of 270 million people that it was hard to bring social change to the whole of the country. However, the country has set up a plan from 2021-2024 in which the government plans to send money to families who have a family member with a disability. 

 

Additionally, the delegation recognizes that shackling is a form of shackling that is still happing today to people around the country today. However, there have been several efforts made in the elimination of shackling such as the enablement of a law that guarantees the exact same rights to a person with a mental disability and the prohibition in their Health regulations. 

 

The Committee's observation will be concluded on September 9th 2022 when the twenty-seventh session of the Committee has been concluded.
